LIABILITY

Subject to the extent permitted by law, in all cases other than in respect of services we provide to a specific customer (which shall be governed by separate contractual terms of engagement), in relation to your use of or inability to use, or delay in the use of, or reliance on any content on, the website or any material in it or accessible from it or from any action or decision was taken as a result of using the website or any such material:

1 – Our maximum liability (whether in tort, contract, misrepresentation, negligence, restitution, or under any other legal head of liability), shall be 100 €.

For the avoidance of doubt, (II) to (XIV) (inclusive) of this paragraph 2 – apply whether such losses are direct, indirect, consequential, or otherwise.
3 – To the extent permitted by law, we exclude all conditions, warranties, representations, or other terms which may apply to the website or any content on it, whether express or implied.

AVAILABILITY

1 – All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.
2 – If one of the ordered products is not available, SIMON LEXTRAIT commits to inform you by email within 7 days after order date. You may then maintain or cancel the order.
3 – In the case where the order is maintained and delivered partially, the client will be charged only the price of the delivered products.
4 – In the case where the order is cancelled, we will refund via your credit card (or original method of payment). You will receive the credit within a few days, depending on your bank’s processing times.

ORDERS

By using the website and/or placing an order on the website you must confirm that you have read and accept these Terms & Conditions. Please make sure you have read the Terms & Conditions before you place an order.

1 – An order can only be placed if you have previously confirmed that you accept these Terms & Conditions.
2 – Please note that products in your shopping bag are not reserved and may be purchased by other customers until you have place the order at checkout and received the order confirmation email.

PRE-ORDERS

The pre-order items are available to order and will be made especially for you in chosen size. Please make sure you have read and understood all the conditions written here before submitting your pre-orders:

1 – We will be producing these items for you, in the size you require, payment will be taken upfront. Pre-orders items will be ready for shipping about 8 weeks after pre-order placements. We will contact you once your pre-order is ready.
2 – The items will then be processed for delivery once the pre-ordered products are ready to be shipped. You can see the estimated delivery date of each pre-order product within the product description on our website. This date cannot be guaranteed due to potential manufacturing delays; however, we do our best to estimate this date as accurately as possible. You may change the delivery address of your pre-order shipment up to 48hrs after you place your order. Unfortunately, we are unable to change your delivery address after this date. We will also require proof of address to be able to change the address on your order for security reasons. Please ensure that you have written your shipping and billing address correctly.
3 – Payment is taken and processed at the time your pre-order is placed. Our method of payment is whether credit card (Stripe) or PayPal. If for any reason we cannot fill your order, a full refund will be issued.
4 – All pre-orders are final, the size and color cannot be adjusted and can’t be canceled. Please ensure when placing a pre-order that you wish to purchase the item and that you are happy with the Terms & Conditions. By placing a pre-order you are agreeing to these pre-order Terms & Conditions. Our usual Terms & Conditions apply. Our shipping policies apply.

MADE-TO-ORDERS

The made-to-orders items are currently not in stock and will be crafted especially for you, in the size you require. Please make sure you have read and understood all the conditions written here before submitting your made-to-orders:

PRICES

1 – All prices are indicated in euros (€) excluding the VAT in force on French territory (article 293 B of CGI).
2 – Prices may be modified by SIMON LEXTRAIT at any moment but are applied as shown on the website at the time of ordering.
3 – Prices do not include shipping fees and are delivery duties unpaid (DDU). You will be responsible for paying Customs/Duty and Import Taxes.

PAYMENT

Debit takes place at the moment the order is validated, on the condition that the debut authorization has been formerly received from the competent payment centers, otherwise the order cannot be taken into account. The website provides its clients with the following modes of payment:
1 – Payments by cards via Stripe
2 – Payment by PayPal

DELIVERY

France – 10 € (1 to 3 working days)
Europe – 15 € (2 to 7 working days)
World – 30 € (3 to 11 working days)

1 – Domestic deliveries (France) are carried out by La Poste. Worldwide deliveries are carried out by DHL Express. Please allow 2-3 days for processing of your order. A tracking number will be sent to you upon shipment. Free shipping on all orders over 300 €.
2 – All products are shipped from France. Please allow 2-3 days for processing of your order. A tracking number will be sent to you upon shipment.
3 – Note that shipping will be applied to your order at checkout. When placing your order, please ensure that the billing and shipping address details are correct, as we are unable to redirect. Please make sure the address you provide is one where our delivery service can obtain a signature upon delivery of your shipment.
4 – If you have not received your parcel within a reasonable time, please send an email at shop@simonlextrait.fr. SIMON LEXTRAIT cannot be held responsible in case of delay and this for any reason whatsoever. Therefore no claim for compensation of any nature whatsoever can be claimed by the user.

EXCHANGE AND RETURN

1 – The purchaser have a lead-time of 14 days from reception date to return the product(s) you have ordered on www.simonlextrait.fr for exchange or refund on the condition that the item is unused, in the same condition that it was received and it must also be in the original packaging with tags still attached. If the last day of the lead-time is a Saturday, Sunday, or public holiday, the lead-time is reported to the following business day.
2 – In order to initiate your return, please email shop@simonlextrait.fr with your order number and reason for return. We will reply to confirm your request within 2-3 days, along with return shipment instructions. Please complete returns in a timely manner.
3 – Once your return is received, it will undergo a quality review. We will send you a prepaid packing slip for the return. Return shipping costs will be deducted from your refund. Damaged or incomplete items will not be taken back and will be returned to you as is, at your expense. Your are responsible for shipping costs associated with returning any item. Customs and duties costs, as well as cost of original shipment will not be refunded.
4 – Please note shipping fees are nonrefundable. Refunds are only permitted for full price items, sale or promotional items cannot be refunded.
5 – We reserve the right to refuse a return that does not comply with the above conditions.

CUSTOM DUTIES AND IMPORT TAX

1 – All international orders are shipped delivery duties unpaid (DDU)
2 – Customs, duties and taxes are not included in the item price or shipping cost.
3 – Applicable fees will be collected from you by the carrier upon delivery.

All content on this website such as images, texts, graphics, logos is in our property unless otherwise stated. You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way, any content in whole or in part. Any violation of these clauses may be the subject of appropriate legal action, in particular for counterfeiting.
